This agreement establishes your use of the website www.telefericgrandhotel.ro (hereinafter referred to as “the website”) and implies that you agree with the disclosure of personal data and that you understand that hotel and tourism services cannot be provided without the disclosure of the requested personal data. Please read the terms and conditions herein carefully before using or acquiring any materials, products or services via www.telefericgrandhotel.ro.

Sc Tint Srl uses personal data for a better understanding of your needs, in order to help you complete transactions or orders, communicate, to provide you with services and support, to keep you updated with its services and with its special or seasonal offers. Occasionally, we use the information provided in order to get in touch with you for the purpose of obtaining feedback regarding the services provided by us, in order to improve and improve to your expectations. We observe the privacy and security of the information provided on this website, including your personal data, which is all covered by the policy herein. If you provide Sc Tint Srl voluntarily with any personal data, you agree to Sc Tint Srl, for the purpose and on the duration established by the specifics of the transaction, recording/registering this data and processing it.

 

2.Data registration

S.C. TINT SRL processes the data provided by you in order to:

  • provide hotel and tourism services;
  • make bookings using the Company’s online or offline booking systems;
  • fill in the accommodation sheet and carry out the payment formalities;
  • send/receive advertising and marketing bids;
  • pursue a legitimate interest in the Company or third party to whom the data is disclosed

which you agreed with the moment you accessed the service.

 

3.Data use

S.C. TINT SRL processes and uses the personal data received in accordance with the provisions of current law. Any financial data collected is used exclusively in order to process payments authorized by means of the online booking service.

Using internal procedures strictly based on the regulations of Law 677/2001, as amended and supplemented by Law 506/2004, we make sure that the collected personal data is not used for purposes other than those you agreed with.

The data will not be revealed to anybody, except for the entitled authorities (the Police, the Romanian Intelligence Service), based on a written request, as per the provisions of current law.

 

4.Data security

The data collected via our website is saved automatically in the internal software system and can only be accessed by our employees based on a username and password. The software system provides advanced sensitive data protection tools and operates in accordance with the PCI-DSS standard (Payment Card Industry – Data Security Standard).

 

5.Disclosure

You are not under any obligation to provide your personal data for the purposes mentioned under Section 1 above. We ensure safe processing of the data provided by you via this website and guarantee your rights provided by Law 677/2001 on personal data processing and the free circulation thereof, and by Law 506/2004 on personal data processing and the protection of private life in electronic communication (the right of access, intervention, of not being subjected to an individual decision, of seeking legal action, opposing any future processing and requesting deletion). 6.Legislation

We observe the provisions of Law 677/2001 on the protection against personal data processing and the free circulation thereof, as amended and supplemented by Law 506/2004 on personal data processing and the protection of private life in electronic communication. The confidentiality policy herein is subject to the current Romanian law. In case of litigations, an amicable settlement will first be attempted, within 30 working days from the registration of the complaint at our registered office. If no agreement is reached within the aforesaid term, the matter will be escalated to the Court of Brașov.

The document herein refers to the conditions in which the www.telefericgrandhotel.ro website may be used. By accessing or using www.telefericgrandhotel.ro, you agree with and to the terms and conditions below. The website is owned by Sc Tint Srl. We reserve the right to amend, change, add or delete parts of these terms at any time, without any notification and, notwithstanding any provisions to the contrary, these amendments become effective immediately; therefore, please look out for any amendments to the terms herein. The fact that you continue using the website after amendments to this Agreement are made means that you accept such amendments.

 

2.User rights

www.telefericgrandhotel.ro users have the right to view the website on a computer monitor, to print parts of the content on paper and save pages electronically solely for personal, non-commercial purposes. The website is available solely for natural persons or legal entities that can enter into valid agreements according to Romanian law. The website and the services are not available for persons under the age of 18. The materials localized on or through the site are supplied by us only for information purposes.

 

3.User obligations

This website, together with all its modules and materials, is registered as Tint Srl property.

You agree to comply with the following observations, including but not limited to:

  • The obligation to not copy, disclose, republish, upload, post, amend, send or distribute the website and the presented materials without Tint Srl’s permission. The unauthorized use of this website and/or the materials contained herein may infringe copyright law, trademarks, intellectual property law or any other legislation.
  • The prohibition of sending political, pornographic, racist or other illegal material.
  • The prohibition of creating databases or handbooks by downloading the website page by page. Copies will only be made according to the terms of use.
  • The information that you provide to us must not contain any viruses, Trojan horses, worms, logic bombs or other malware aiming to interface or intercept our system.

8.Rates

The rates displayed are per night and include VAT,  free wifi, spa access and breakfast. Rates doesn’t include mountain rescue fee of 2 Ron/Day/Person. They are expressed in euros and are converted as per the NBR exchange rate on the date of arrival.

Local special tax for the tourist promotion of Brasov Municipality, in the amount of 1 RON per day, per person, is not included.

We can only confirm your booking if you provide all the information we require. Please make sure that all your personal data is correct.

The booking may be cancelled free of charge up to 7 days before arrival, 6 PM. In case of non-attendance or late cancellation, Sc Tint Srl reserves the right to charge the price for the first night of accommodation without prior notification, on the credit card used for guaranteeing the booking.

 

9.Notifications

Any notifications in relation to the terms and conditions of the website can be sent to office@telefericgrandhotel.ro.

 

10.Termination

The terms herein apply throughout the duration of your access to the website. You may terminate the applicability of these terms at any moment by disconnecting from the website and destroying any materials obtained and any related documents, drawn up as per the terms of the Agreement or in any other way.

 

11.Applicable law

The applicable law is the Romanian law. Any litigations related to the agreement herein will be settled by the court of competence over the headquarters of Sc Tint Srl. You agree to the fact that any legal proceeding resulting from or in relation to the terms and conditions of the Agreement herein will be forwarded to the Romanian courts of jurisdiction over the headquarters of Sc Tint Srl.

 

12.Pets

Pets are not accepted at the hotel.

 

13.Accepted means of payment

  1. Legitimate reason and legal grounds for video surveillance

The use of video surveillance systems is necessary for maintaining an optimal social climate and for increasing safety, security and access control within the premises of TINT SRL, as provided by the Law no. 333/2003 on the security of objectives, assets and valuables and protection of individuals, as well as by the Government Decision no. 301/2012 for the approval of implementing regulations of the Law no. 333/2003 on the security of objectives, assets and valuables and protection of individuals.

Legal framework

  1. Law no. 333 of July 8th2003 on the security of objectives, assets and valuables and protection of individuals, with subsequent amendments and additions;
  2. Government Decision no. 301 of April 11th2012 for the approval of implementing regulations of the Law no. 333/2003 on the security of objectives, assets and valuables and protection of individuals;
  3. Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);
  4. Instructions from the European Authority for the Protection of Personal Data regarding video surveillance.
  5. Purpose and scope of the video surveillance policy

TINT SRL operates a video surveillance system for preventing, discouraging, managing and investigating safety and security incidents, as well as for the protection of individuals and assets (from fires, thefts, breaking and entering, assaults or from any other threat). The video surveillance system supports the accomplishment of common goals regarding security and access, by monitoring specific areas and events. The system is a part of the measures destined to support the security policies of TINT SRL. The data controller of the video surveillance processing operations is the Security Department of TINT SRL.

This policy regulates the mechanisms for using the video surveillance system, as well as the measures adopted by TINT SRL in order to protect personal data and the private life of individuals within the premises of TINT SRL and nearby.

The elements of this surveillance policy are applicable in all the spaces of TINT SRL.

  1. Making sure that the video surveillance system works in accordance with the legal provisions regarding private life and data protection.
  • Revision of the current system

The procedures of TINT SRL are revised periodically in order to assure compliance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

  • Compliance

TINT SRL processes the footage in accordance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

  • CCTV system

The Closed-circuit-television (CCTV) system of TINT SRL may be submitted periodically to a risk analysis for each surveillance camera. Based on analyses and having as objective to reduce to a minimum the monitoring of areas which are not relevant for the intended purpose, the location of cameras and angles of view can be changed, replaced or confirmed.

  • Transparency

The video surveillance policy is available and published on the website of TINT SRL (www.telefericgrandhotel.ro).

3.7. Revision of policy

The system operator performs a revision of the proportionality for using the video surveillance system over protection of personal data every two years. During these regular revisions, he/she shall determine if:

  • There is still  need for a video surveillance system;
  • The system continues to serve its intended use;
  • There aren’t further appropriate alternatives.

The periodical revisions shall also deal with other problems identified during the exploitation of the system, especially if the video surveillance policy of TINT SRL continues to comply with the legislation and instructions in force and if it is complied with in practice.

3.8. Technological solutions which respect private life

When ordering new equipment for the system and if possible, TINT SRL shall use the optimal technological solutions which live up to the standards and level of the latest available technologies.

  1. Areas under surveillance

The location of surveillance cameras and of angles of view is based on a risk analysis, making sure that the cameras are placed exactly towards the most important areas within the building.

The surveillance cameras are placed in order to monitor the entrance and exit points of the premises of TINT SRL. Moreover, there are cameras monitoring connection points, as well as the proximity of certain major areas which need additional surveillance, such as areas where sums of money are kept, the reception area, as well as restricted areas.

The areas destined to provide a higher degree of discretions, such as offices are not monitored. The areas destined to provide a maximum degree of discretion, such as hotel rooms, shower cabins, toilets or other similar locations are never monitored.

The monitoring performed outside the premises of TINT SRL is limited to a minimum.

  1. Categories of personal data collected and the purpose of their collection
  • Technical characteristics of the system

The video surveillance system of TINT SRL is a conventional system. All surveillance cameras are working 24/7, 7 days a week. The quality of images in most cases allows the identification of the people within the range of the surveillance camera. The camera records digital images, registering captured images, as well as the time, date and place. We do not use state of the art technology or intelligent video surveillance, we do not interconnect our system with other systems and we do not use audio recordings or “audio CCTV”.

  • The purpose of video surveillance

TINT SRL uses the surveillance system in order to guarantee safety, security and access control. The surveillance system contributes to controlling the access into the building and assures security and safety of buildings, of the staff, tourists and visitors, as well as of assets and documents which are kept in the office.

The video surveillance system helps to prevent, discourage, manage, and, if necessary, to investigate incidents related to safety and security, to potential threats or unauthorized physical access, including unauthorized access into buildings or IT infrastructure.

  • Purpose limitation

The system is not used for other purposes, except for the ones mentioned above. For example, it’s not used to monitor the attendance of employees. The system is not used either as an investigation instrument for other purposes than the ones mentioned above, except for the cases when we are dealing with an incident regarding physical safety or with a crime. The records can be sent to the investigation bodies within a disciplinary investigation or an official criminal one.

  • Web cameras

TINT SRL does not use web cameras for purposes related to the protection of safety and security.

  • Special categories of data

The video surveillance system of TINT SRL does not have the objective to collect special categories of data, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, memberships to unions or data concerning health or sexual orientation. Still, the system may process special personal data regarding health if amongst the tourists or visitors of the hotel there are people with visual impairment or with physical disabilities (for example, people in wheelchairs or people who use the access ramp).

The CCTV system monitors the minimum necessary area for assuring the safety and security of the building. Taking into account the high level of exposure of the building of TINT SRL from the point of view of security (the perimeter is easily accessible), the entrances and perimeter of TINT SRL are all equipped with surveillance cameras. The purpose of using these cameras is not to record or process special categories of data, nor to focus on a special individual, but to be able to prevent, assess and investigate security incidents.

The monitoring system operators are regularly trained on the data protection and fundamental rights.

  1. The right to access information and its beneficiaries
  • Internal and external staff for maintenance and security

TINT SRL manages internally its video surveillance operations.

The video footage is accessible only to the employees of TINT SRL that have competencies in this matter, based on the “need-to-know” principle.

TINT SRL shall not disclose to anyone the video images, except for the law-enforcement agents, public prosecutor’s offices and courts of law, at their express request.

The maintenance of the video surveillance system is conducted by an outsourced contractor, under the supervision of a security officer of TINT SRL.

  • The right to access personal data

With respect to video surveillance, TINT SRL establishes and documents who has access to video surveillance records and/or to the technical architecture of the video surveillance system and for what purpose and what the said access rights are.  For these purposes, TINT SRL establishes who has the right:

  • To view the real-time images;
  • To view the images recorded;
  • To copy;
  • To download;
  • To delete;
  • To modify images.

The access rights are established through a decision delivered by the management of TINT SRL.

  • Training of employees concerning data protection

All employees with access rights, including the outsourced security agents and maintenance technicians are trained with respect to data protection.

  • Nondisclosure agreements

The employees with access rights, including the outsourced staff that performs CCTV operations or operations for system maintenance, sign nondisclosure agreements in order to guarantee that they do not transmit, show or disclose to anyone and under no circumstances the content of the video surveillance images, except to authorized recipients.

  • Transfers, conveyances and registers

The information collected pursuant to the processing of personal data, including CCTV images, may be sent to legal authorities or law-enforcement agents, in order to investigate or prosecute offences.

These transfers are only completed on demand. There are no regular or routine transfers.

  1. Protection of personal data

In order to protect the security of the video surveillance system as a whole, including personal data, a series of technical and organizational measures are implemented.

All possible actions are taken, both technical and physical, in order to assure the security of the system and the data protection, among others:

  • The staff (outsourced and internal) sign nondisclosure and confidentiality agreements;
  • Users are granted access rights only to those resources which are strictly necessary in order for them to carry out their activities (based on the “need-to-know”);
  • Elaborating an updated list of all positions/jobs that have permanent access to the system and the description of their access rights.
  1. Data retention

The period of retaining the footage captured by the video surveillance system is of 20 days.

This retention period is essential for security investigations, because due to the presence of users in various activity locations, in many cases, the complaints are submitted after a long time since the incident.

If there is a necessity that an image be retained for subsequent investigations or as evidence in case of a security incident, this may be kept during the investigation and, if necessary, it may be archived, together with the investigation, for a period of up to a year.

  1. Furnishing information to the public

We furnish information concerning video surveillance to the public (people who walk by the premises of TINT SRL and/or who enter the premises of TINT SRL) with efficiency and in detail. For these purposes, we pursue a multilayer approach which consists of a combination of the following methods:

  • Announcements on the spot to alert the public (passers-by, drivers, visitors, staff, etc.) with respect to the fact that monitoring takes place and that essential information is being furnished concerning processing;
  • Availability of a brief of this video surveillance policy at the hotel reception;
  • Availability of this video surveillance policy on the website of TINT SRL (www.telefericgrandhotel.ro) for the people who want more details about the practices of our company concerning video surveillance.
  1. Rights to access, correct and delete personal data

The public has the right to access the personal data we keep on them and to correct and complete them. Any request to access, correct or delete personal data must be addressed to:

We shall respond thoroughly to all requests within 30 calendar days. If this is not possible, the applicant is informed on the subsequent steps and reason for postponement within 30 days. Even in the most complex cases, we shall provide access or a justified final answer, in case the request is dismissed, within 3 months at the most. All measures shall be taken in order to have a more prompt answer, especially if the applicant states that the request is urgent.

If expressly requested, we may set up a viewing and the applicant may obtain a copy of the images recorded. If this is the case, the applicants must disclose their identity beyond any doubt (for example, they must present identification documents at the viewing) and, whenever possible, specify also the date, time, location and circumstances in which they were filmed by the camera. They must also furnish a recent photo of their own, that allows the security personnel to identify them in the analyzed footage.
